PRIVACY POLICY
tw telecom Inc. and its affiliates (collectively "TWTC") are committed to protecting the privacy of its customers. To accomplish this, we carefully ensure the confidentiality of each customer's account information. And we recognize that, as the provider of telecommunications services, we must also ensure the privacy of each customer's telephone calling information.

All TWTC employees are subject to TWTC's Code of Business Conduct. The Code requires all TWTC employees to follow every law, rule, regulation, court and commission order that applies to our business at all times. In addition, the Code specifically requires compliance with legal requirements and company policies relating to the privacy of communications and the security and privacy of customer records. Employees who fail to meet the standards embodied in the Code of Business Conduct may be subject to disciplinary action, up to and including dismissal.

PRIVACY PRACTICES – SUMMARY
To provide customers with their own accurate, detailed billing information, TWTC maintains detailed records. TWTC will not sell this Customer Proprietary Network Information (CPNI) - in any form, including billing records, calling habits or type of service - to unaffiliated third parties.
To ensure that you will not receive recurring marketing information from us unless you choose to, TWTC provides simple instructions on each marketing e-mail that enables you to let us know that you do not wish to receive such e-mails from us.

We will keep customers' personal information secure and confidential through safeguards such as secure encryption technology and by requiring user names and passwords to access personal information.

INFORMATION COLLECTED AND HOW IT IS USED
Information used and disclosed to provide products and services
TWTC uses customer information or "individually identifiable information" such as name, address or phone number to monitor our customers' quality of service and to provide products and services.

TWTC may share necessary information with outside parties, such as billing vendors, to complete an order.
TWTC may, where permitted by law, provide information to credit bureaus, or provide information or sell receivables to collection agencies, to obtain payment for TWTC-offered products and services.

TWTC or one of our authorized agents may also use this customer information to market and sell TWTC-offered products and services. When TWTC uses authorized agents to perform services on its behalf, TWTC requires that they protect your personally identifiable information consistent with this policy.

INFORMATION DISCLOSED TO THIRD PARTIES
TWTC, as a rule, allows customers to control the disclosure of their personal information (such as name, address and telephone number) to third parties for the marketing of third-party products and services.

TWTC must disclose information, when requested, to comply with court orders or subpoenas. We will also share information when necessary to prevent unlawful use of communications services when necessary to repair network outages and when a customer dials 911 and information regarding their location is transmitted to a public safety agency.

Your name and number may also be transmitted and displayed on a Caller ID device unless you have elected to block such information. Please note that Caller ID Blocking does not prevent the display of your number when you dial certain business numbers, 911, 900 numbers, or toll-free 800, 888, 877 or 866 numbers.

CUSTOMER PROPRIETARY NETWORK INFORMATION (CPNI) – BACKGROUND
CPNI: What is it?
In the normal course of providing communications services, TWTC collects and maintains certain information about customer accounts. This information, when matched to a customer's name, address and calling or originating billing telephone number is known as "Customer Proprietary Network Information," or CPNI for short.

Examples of CPNI include information typically available from details on a customer's monthly telephone bill -- the type of line, technical characteristics, class of service, current telephone charges, long distance and local service billing records, directory assistance charges, usage data and calling patterns.
TWTC does not sell CPNI to unaffiliated third parties and abides by the federal and/or state CPNI rules that apply to all telecommunications carriers.

TWTC does provide CPNI to third parties for the purpose of marketing TWTC products and services. These third parties are bound by non-disclosure agreements, meaning they may not reveal a customer's CPNI to anyone else.
Use of CPNI may be restricted. If you would like to restrict the use of your CPNI for the marketing of certain products and services, please email us at www.twtc.cpni@twtelecom.com or call us at 1-888-333-0520. When making such a request, please be sure to reference the customer name as shown on the billing invoice, the account number(s) you wish restricted and the billing address(es) associated with the account(s) in question Restricting use will not eliminate all TWTC marketing contacts.

EMAIL MARKETING PRACTICES
We periodically send interested customers news via email regarding products, new offers and special promotions. If you do not wish to receive email marketing messages respond and request removal via the mechanism conveyed on the marketing email itself.

HOW WE PROTECT YOUR DATA
We maintain and protect the security of our servers and your personal information.
To secure the information collected online, prevent unauthorized access, maintain data accuracy and ensure only appropriate use of information, TWTC has established appropriate physical, electronic and management safeguards.
We require user names and passwords to access sensitive data.

Unless you authorize unencrypted transmission, we will use industry standard encryption methods to protect your data transmission.

TWTC Web sites may contain links to other external Web sites. We are not responsible for the content or privacy of other Web sites.

ONLINE ACCESS BY CHILDREN POLICY
